I.- Ownership of the Portal

PARQUES REUNIDOS SERVICIOS CENTRALES, S.A. ("PARQUES REUNIDOS" or "We") with registered office in Madrid, Federico Mompou, 5, Parque Empresarial "Las Tablas", Edificio 1 - Planta 3ª, 28050, Madrid (Spain), with Tax Id. number A-84.885. 441 and registered in the Commercial Registry of Madrid in Volume 23.506, Folio 58, Page M-421.702, is the owner of the domain https://torrevieja.aquopolis.es/, together with the portal and its contents (the "Portal"). We make the Portal available to You for the purpose of giving You information about our (and our subsidiaries') (collectively, the "PARQUES REUNIDOS GROUP”) products and special offers, allowing You to purchase tickets and other products and services available on the Portal, and where appropriate, making available to You certain contact forms, newsletters, competitions, games, and surveys related to the PARQUES REUNIDOS GROUP.

When You purchase any products and/or services available on this Portal, your seller or service provider will be LEISURE PARKS, S.A., a company of the PARQUES REUNIDOS GROUP. LEISURE PARKS is the operator of the Portal and the Aquopolis Torrevieja leisure park. LEISURE PARKS also sells products and/or services related to the Aquopolis Torrevieja. Details of LEISURE PARKS, S.A. are as follows:

II.- Standard Terms and Conditions

 

These Standard Terms and Conditions apply when You purchase any services or products available on the Portal from GRUPO PARQUES REUNIDOS (the "Standard Terms and Conditions").

These Standard Terms and Conditions have been drawn up pursuant to the provisions of Spanish Law 34/2002, of 11 July, on information society services and electronic commerce, Spanish Law 7/1998, of 13 April, on Standard Terms and Conditions, Spanish Royal Legislative Decree 1/2007, of 16 November, enacting the General Law for the Defence of Consumers and Users and other supplementary laws, Spanish Law 6/2020, of 11 November, regulating certain aspects of electronic trust services and any other relevant statutory provisions.

These Standard Terms and Conditions are accessible at all times in the online purchase section of the Portal and may be printed and/or saved into your computer or other device.

 

1. PRE-CONTRACT INFORMATION

These Standard Terms and Conditions set out the general terms and conditions applicable to the services provided by GRUPO PARQUES REUNIDOS on the Portal and, in particular, any services currently provided by GRUPO PARQUES REUNIDOS, the sale of certain tickets and season passes for admission to any leisure parks managed by GRUPO PARQUES REUNIDOS and, where appropriate, other products available on the Portal.

Tickets and season passes, including any other products available on the Portal, are sold for a fee. Prices for each product (including taxes) are quoted in euros. Applicable promotions and discounts, where applicable, will be as specified on the Portal at any time. The total price will be displayed on the Portal at the time of purchase, detailing any surcharges or discounts/promotions applied. Details of other additional charges for ancillary services or for the use of certain methods of payment are also included.

Access to the information contained in the Portal is free of charge.

You acknowledge that the information available on the Portal, the general information on our product catalogue, and other products or services available on the Portal, including these Standard Terms and Conditions, is adequate to exclude any error in forming your consent to enter into an agreement with us.

1.1 Procedures

To use the different purchase services available on the Portal, please follow the on-screen instructions and prompts displayed at each stage of the purchase process. By filling in the information required on the Portal forms, You will be deemed to have read, understood, and accepted these Standard Terms and Conditions and special conditions set out therein. Therefore, You confirm that You are aware of and accept these procedures as necessary to purchase any products and services available in the PURCHASE section of the Portal.

Your rights and obligations, both during and after your purchases, are also subject to these Standard Terms and Conditions, the Portal General Terms and Conditions of Use, the Special Terms and Conditions, and to the Rules of Operation of the Park.

To make an online purchase You need to complete all the steps set out in the PURCHASE section of the Portal. These Standard Terms and Conditions and any applicable Special Terms and Conditions, as the case may be, will become part of your contract with us after You confirm your express acceptance by filling in and sending the purchase details entered in the PURCHASE section.

By accessing the Portal and using any of the Portal's services, You unconditionally agree to accept the Portal General Conditions of Use, these Standard Terms and Conditions and, where applicable, the Special Terms and Conditions made available to You before completing your purchase. These terms and conditions apply to the purchase of tickets or season passes and/or any other products and services available on the Portal.

You represent that you have the required legal capacity to be bound by these Standard Terms and Conditions and to use and make purchases on the Portal, in accordance with any applicable Special Terms and Conditions. You also hereby declare to know, understand, and accept these Standard and Special Terms and Conditions in full. Your use of any purchased products is at your own risk and responsibility.

1.2 Documentation and language

These Standard Terms and Conditions are accessible at all times in the PURCHASE section of the PARQUES REUNIDOS Portal and may be printed and saved on your computer or other devices.

When You buy a ticket, you will receive an email within twenty-four (24) hours, or such other deadline legally applicable at that time, together with a receipt for your purchase (the "Ticket"). Tickets include a unique barcode which You can use to enter the park premises. Tickets that appear to be damaged or otherwise tampered with will automatically be null and void.

Unless otherwise expressly provided in the Special Terms and Conditions, Tickets purchased online from the Portal for a specific date will only be valid for that date.

If You purchase any other products and/or services other than Tickets, You will also receive a purchase receipt (also referred to herein as the "Ticket") no later than twenty-four (24) hours (or such other deadline legally applicable) of completing your purchase. The Portal will inform you of any Special Terms and Conditions applicable to such products or services before your purchase.

Upon issuance of the Ticket, the requirements set out in Spanish Royal Decree 1619/2012, of 30 November, enacting the Regulations applicable to invoicing obligations, shall be deemed to have been fulfilled.

Please note that We do not accept changes or refunds once your purchase is completed and upon issuance of the relevant Ticket. Exceptions may be made in the cases expressly set out in the Special Terms and Conditions and/or as provided under applicable regulations. If You wish to make a change or claim a rfund, please contact our Bookings Team (aquopolis.torrevieja@grpr.com).

The Standard Terms and Conditions are written in Spanish and your purchases will be processed in this language.

1.3 Technical resources

The Portal will make available to You the required technical assistance to enable You to detect and correct errors when filling out any of the forms shown on the screen during the purchase process.

1.4 Amendments to the Standard Terms and Conditions

These Standard Terms and Conditions are effective as of the date of their last update (as shown at the end of this document). GRUPO PARQUES REUNIDOS reserves the right, acting in good faith and fairly, to amend these Standard Terms and Conditions, the Special Terms and Conditions, and any other general or specific conditions or rules of use or notices at any time. These amendments shall be effective upon their publication and shall only apply to You when You first access the Portal after such publication. For the avoidance of doubt, should there be any changes to these Standard Terms and Conditions, GRUPO PARQUES REUNIDOS will honour any prior commitments acquired before the date of publication of such changes.

You may consult these Standard Terms and Conditions and any applicable Special Terms and Conditions at any time before you decide to purchase any products or services. However, please note that we reserve the right to change at any time the layout, configuration and location of the Portal, its contents and the Portal terms and conditions of use.

1.5 Exchange and refund policy. No cancellation (cooling-off) right.

Pursuant to article 103.l) of Spanish Royal Legislative Decree 1/2007, enacting the General Law for the Defence of Consumers and Users (as amended) and other ancillary regulations, unless otherwise expressly stated in the Special Terms and Conditions related to your product or service, we regret we cannot accept any exchanges or refunds for products with a given expiry date.

For the avoidance of doubt, your right of cancellation (cooling off) does not apply to this type of products.

1.6 Price and methods of payment

The price of your selected products is shown before you make your purchase and is inclusive of taxes.

Prices are displayed before purchase and include any products that You wish to purchase. Prices include all applicable taxes.

Subject to any restrictions imposed by applicable regulations, the Portal accepts the following payment methods: debit or credit card (specifically, Visa, Mastercard and Maestro) Amazon Pay and any other payment platforms supported by PARQUES REUNIDOS from time to time.

Certain payment methods supported by the Portal may also take the form of credit transactions. These are short-term credit operations (usually involving a repayment period not exceeding three months), under the common denomination of "Buy Now, Pay Later" or "BNPL". Please note that PARQUES REUNIDOS does not finance BNPL purchases. Financing will be offered by an independent credit provider unrelated to PARQUES REUNIDOS. Likewise, We do not act as brokers or intermediaries between the financial institution and You. Therefore, We regret We are unable to assist or otherwise advise You in making any financing decisions.

If you choose to use BNPL, please note that You will be entering into a credit agreement in which you assume a payment obligation with a third party other than PARQUES REUNIDOS. Please note that using external financing options may provide you with greater flexibility and convenience in meeting your financial needs, but may also increase your risk of excessive debt, resulting in additional costs associated to later repayment.

PARQUES REUNIDOS guarantees that appropriate security measures are in place and that these comply with safety standards currently available in the industry, including the Verisign system. Access to transactional services and services involving the collection of personal data is made in a secure environment using the 128-bit encrypted SSL (Secure Socket Layer) protocol. A secure server establishes a connection to ensure that any information transmitted is encrypted. This ensures that such content can only be read by the client computer and our server. You may verify that you are in a secure environment if a closed padlock is displayed in the status bar of your browser. The security of our servers is certified by VeriSign. This guarantees that You are sending your data to a PARQUES REUNIDOS server and not to an impersonating third party.

As part of our commitment to fraud prevention, PARQUES REUNIDOS will cooperate with any payment platforms used for the purchase of products through the Portal. We will also assist the competent authorities by providing information on any transaction in compliance with applicable legal requirements.

PARQUES REUNIDOS is not responsible for the content of any websites accessed by You by clicking on any links contained in our Portal. Please be aware that we are not able to review or monitor the content of any third-party websites. Finally, we make no guarantee as to the availability, accuracy, veracity, validity, or lawfulness of external sites accessible via links displayed on the Portal.

1.7 Incorporation by reference of the Special Terms and Conditions and the Rules of Operation of the Park.

By purchasing and using any product via the Portal, You accept the Standard Terms and Conditions, the Special Terms and Conditions applicable to the products and services purchased, and the rules of operation of the Park available for review at Rules of Operation. Please read them carefully before proceeding with your purchase.

III.- Special Terms and Conditions

PARTICULAR CONDITIONS FOR DIFFERENT PRODUCTS

SPECIFIC CONDITIONS APPLICABLE TO THE PURCHASE OF TICKETS AND ONLINE TICKETS:

These particular conditions apply to the following types of tickets:

  • General 1 DAY: from 140 cm tall.
  • Reduced 1 DAY: between 100cm and 140cm in height.
  • Weekly Pass (General / Reduced)

 

  1. The ticket will only allow access to the Aquopolis Torrevieja, as specified in the Ticket itself (the “Park” / the “Parks”).
  2. The User must not cut, manipulate, damage or photocopy the Ticket. If any of these circumstances occur, we can prevent you from accessing the Park.
  3. The User can directly access the Park by showing the paper ticket or the downloaded QR Code to the lathe staff.
  4. If the User makes any type of error when purchasing a certain type of ticket through the Portal or the Park or Parques Reunidos app (for example, purchasing reduced tickets instead of general tickets, tickets for a day different from the one you really want to go to the Park, etc.) you must make the appropriate change at the Park ticket offices and pay, if applicable, any difference in price. For this change, the official retail price (RRP) of the general admission ticket to the Park (€32.95) will be taken as a reference and not the advance ticket sale price that appears on the Portal or the app, the User will pay the difference in the price of the tickets, when applicable. In the same way, you will be paid the difference that, if applicable, could occur in your favor by means of a bank transfer to the same account that the User indicated for the purchase of tickets through the Portal.
  5. The ticket will be valid for the date(s) collected therein and during the opening hours listed on the Park's website. In this way, the ticket is valid EXCLUSIVELY for the day(s) indicated in the upper box "Validity Date". See calendar and opening hours at https://torrevieja.aquopolis.es/or at 965 715 890.
  6. The ticket cannot be combined with other promotions or discounts. Changes or returns will not be accepted with respect to having a specific date for your enjoyment, in accordance with the provisions of article 103.l) of Royal Legislative Decree 1/2007, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. In other words, the right of withdrawal does not apply to this type of product, taking into account the nature of the product.
  7. Each ticket has a unique control barcode that allows ONLY ONE ACCESS to the Parks (except in the "Weekly Pass" modalities, in which case it will allow one access for each of the seven days of validity). Once validated, it cannot be used later.
  8. If, for any reason, the User needs to leave the Park, they must contact the access staff or the Customer Service so that they can enable access again. If the User leaves the premises without properly communicating it, they will not be allowed to enter again.
  9. If the User has purchased a ticket subject to special conditions (people with disabilities; over 65 years; large family; etc.) they must prove compliance with these conditions at the time of access to the venue, showing official supporting documentation (ID, disability card, etc.). Admission will be free for children who are under 100 centimeters. However, to be able to enter for free they must be accompanied by a person with a general or reduced payment ticket, or acquired through another title that enables access.
  10. The User must keep his ticket during his entire stay in the Park and show it at the request of any employee.
  11. The resale of the ticket to third parties is prohibited.
  12. The User is informed that the Park may be closed for adverse weather, capacity, security and public health reasons. The Park will try to notify as much in advance as possible through the Portal and the official profiles on social networks and will offer the User a new date to enjoy their tickets or any other measure that allows maintaining the balance of the contractual relationship.
  13. The Rules of Operation of the Park are incorporated by reference https://torrevieja.aquopolis.es/normas-de-funcionamiento/. The purchase and use of any item sold over the Internet entails the acceptance of the online purchase conditions, as well as the acceptance of the Rules of Operation.
  14. The User is informed that some attractions, shows, restaurants, stores and/or rides  may remain closed for organizational or technical reasons, which may include maintenance, repairs, updates and/or improvements, as well as for meteorological reasons that make it impossible or inadvisable to open them for safety reasons or due to the technical limitations of the attractions or facilities due to rain, hail, snow, wind or changes in temperature. PARQUES REUNIDOS will try to give as much advance notice as possible through the Portal, the official profiles on social networks and at the Park's information points

 

SPECIAL CONDITIONS APPLICABLE TO THE PURCHASE OF FAST PASSES (“SPEEDY PASS”)

  1. This product is additional and, therefore, does NOT include the entrance to the Park. On the day of his/her visit, the User must go to the rental office located at the entrance of the Park. There they will scan your reservation code and place your Speedy Pass wristband on you.
  2. The Speedy Pass offers less waiting time on certain attractions: Minis, ZigZag, Pistas, Tirolina, Rápidos, Black Hole, Boomerang, Hydro Racer.
  3. The following attractions do not accept the Speedy Pass: Río Lento, Kamikace and Speed.
  4. The Speedy Pass does not give preference in the choice of seats in the different attractions.
  5. The Speedy Pass is subject to availability. The number of units put up for sale daily is limited.
  6. The Speedy Pass entrance will close 15 minutes before the Park closes.
  7. The User must go to the special accesses for Speedy Pass. For these accesses, you will enter before those who do not have this pass, although the access of Users of the Speedy Pass will alternate with that of Users in the ordinary access row. To repeat in the same attraction, at least 15 minutes must elapse.
  8. The User must take into account that in those attractions where access is shared with disabled people, they will always have preference.
  9. Exclusive use for the day of purchase. Changes or returns will not be accepted when there is a specific date -or a specific period- for your enjoyment, in accordance with the provisions of article 103.l) of Royal Legislative Decree 1/2007, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. In other words, the right of withdrawal does not apply to this type of product, taking into account the nature of the product. Its sale to third parties is prohibited.
  10. The Speedy Pass is personal and non-transferable. Any manipulation will mean its withdrawal.
  11. The exchange of damaged and/or manipulated bracelets will not be accepted.
  12. It is mandatory to wear the bracelet correctly placed on the wrist, not allowing access to people who do not meet this condition.
  13. The Park will not be responsible for the loss of the bracelet.
  14. The Rules of Operation of the Park are incorporated by reference https://torrevieja.aquopolis.es/normas-de-funcionamiento/ and to the rules and restrictions of use of the attractions.

 

SPECIAL CONDITIONS APPLICABLE TO THE PURCHASE OF THE “ALL INCLUSIVE” MENU

These particular conditions apply to the following types of All Inclusive Menu:

  • All Inclusive Adult Menu: from 140 cm tall.
  • All Inclusive Junior Menu: between 100cm and 140cm tall

 

  1. This product is additional and, therefore, does NOT include the entrance to the Park.
  2. You must go to the rental office located at the entrance of the Park with the All Inclusive Menu Ticket or the downloaded QR Code. There they will scan the code of your reservation and they will place your All Inclusive bracelet that entitles you to:
    • Acquire a complete menu -or a drink- in the restaurant that you decide for each hour. 1 bottle of water, a medium soft drink or a medium beer is included.
    • A 50% discount on the purchase of alcoholic beverages.
  3. The User has at his disposal, both on the Park's website and at the catering point, all the necessary information regarding substances that can cause allergies or intolerances so that you can make the right choice for your needs. Both the PARQUES REUNIDOS GROUP and the Park decline any responsibility in the event that the User consumes a product to which they are allergic and/or intolerant, as well as for the consumption of products by the User contrary to the labeling or the information indicated in point restoration.
  4. The All Inclusive Menu is valid at all restoration points. Candy stores are not included. Check the schedule on the day of the visit at the Customer Service Office.
  5. The exchange of damaged and/or manipulated bracelets will not be accepted.
  6. It is mandatory to wear the bracelet correctly placed on the wrist, not allowing access to people who do not meet this condition.
  7. The bracelet is personal and non-transferable, so one bracelet is necessary per person per day. If you have purchased a type of ticket that allows access for two or more days, you must purchase an All Inclusive Menu for each day you want to enjoy this product.
  8. The Park reserves the right to close the catering facilities for reasons of capacity, security, food and/or public health reasons.
  9. Since it is a product linked to a ticket to the Park, changes or returns will not be accepted if it has a specific date -or a specific period- for your enjoyment, in accordance with the provisions of article 103.l) of Royal Legislative Decree 1 /2007, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. In other words, the right of withdrawal does not apply to this type of product, taking into account the nature of the product to which they are associated. It is not combinable with other promotions or discounts.
  10. The Rules of Operation of the Park are incorporated by reference https://torrevieja.aquopolis.es/normas-de-funcionamiento/ and to the rules and restrictions of use of the attractions.
  11. Forbidden its sale to third parties.
  12. Users may only place an online order that includes the purchase and/or delivery of alcoholic beverages through the Portal if they are of legal age. When placing an Order that includes alcoholic beverages, the User must confirm that they are at least 18 years old. PARQUES REUNIDOS reserves the right to refuse to deliver the Alcohol Order to the person who cannot prove they are at least 18 years old at the time of picking up the Order, which must be proven by showing the National Identity Document when picking up the Order physically on the premises. The User who, being of legal age, purchases alcoholic beverages through the Portal will be responsible for not providing those alcoholic beverages to minors under 18 years of age.

 

PARTICULAR CONDITIONS APPLICABLE TO THE PURCHASE OF MENU

These particular conditions apply to the following types of Menu:

  • Burger Menu
  • Children's Burger Menu
  • Hot Dog Menu
  • Healthy menu.
  1. This product is additional and, therefore, does NOT include the entrance to the Park.
  2. The printed sheet or the QR Code downloaded from the menu option, will be exchanged for the Menu modality that you choose and which includes, according to the modality:
    • 1 Hamburger (Burger Menu)
    • 1 Small Hamburger or 1 Chicken Nuggets (Children's Burger Menu)
    • 1 Hot Dog (Hot Dog Menu)
    • 1 Salad (Healthy Menu)
    • 1 French fries (Except in the "Healthy Menu" option)
    • 1 Drink (bottle of water, soft drink in all Menus or medium beer -not available in the Children's Burger Menu-).
    • The Children's Burger Menu includes a yogurtkit or drinkable yogurt to choose from.
    • When you arrive at the Park, check the restaurant points where you can exchange your menu option.
  3. The User has at his disposal, both on the Park's website and at the catering point, all the necessary information regarding substances that can cause allergies or intolerances so that you can make the right choice for your needs. Both the PARQUES REUNIDOS GROUP and the Park decline any responsibility in the event that the User consumes a product to which they are allergic and/or intolerant, as well as for the consumption of products by the User contrary to the labeling or the information indicated in point restoration.
  4. Each Menu corresponds to a Ticket-Menu with its corresponding unique control code that gives the right to a single exchange.
  5. The Ticket-menu corresponding to the Menu will be exchangeable from the opening to the closing of the aforementioned points of sale. Check the schedule on the day of the visit at the Customer Service Office. The exchange for another type of menu will not be allowed.
  6. The Ticket-menu should not be missed, since it will be required to the User when making the exchange at the restoration point. The User must not cut, manipulate, damage or photocopy the Ticket. If any of these circumstances occur, it cannot be exchanged for the Ticket-menu.
  7. The Park reserves the right to close any of the catering facilities for reasons of capacity, security, food and/or public health reasons.
  8. Since it is a product linked to a ticket to the Park, changes or returns will not be accepted if it has a specific date -or a specific period- for your enjoyment, in accordance with the provisions of article 103.l) of Royal Legislative Decree 1 /2007, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. PARTICULAR CONDITIONS APPLICABLE TO THE PURCHASE OF VIP PACKAGES

  1. VIP Packages are complex combined products, therefore the particular conditions apply to them -and therefore they are incorporated by reference- of the following products that include:
    • 1 Entrance to (General or Reduced)
    • 1 Pass “Speedy Pass”.
    • 1 “All Inclusive” Bracelet (Adult or Junior).
  2. Changes or returns will not be accepted when there is a specific date -or a specific period- for your enjoyment, in accordance with the provisions of article 103.l) of Royal Legislative Decree 1/2007, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. In other words, the right of withdrawal does not apply to this type of product, taking into account the nature of the product.
  3. This product cannot be combined with other promotions or discounts. No changes or refunds are allowed. Sale to third parties is prohibited.

  5. Forbidden its sale to third parties.

 

SPECIAL CONDITIONS APPLICABLE TO THE PURCHASE OF THE PLATINUM VIP AREA

Changes or returns will not be accepted when there is a specific date -or a specific period- for your enjoyment, in accordance with the provisions of article 103.l) of Royal Legislative Decree 1/2007, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. In other words, the right of withdrawal does not apply to this type of product, taking into account the nature of the product.
  4. This product cannot be combined with other promotions or discounts. No changes or refunds are allowed. Sale to third parties is prohibited.

IV. Severability of these Standard Terms and Conditions

If any of these Terms and Conditions is found to be invalid or unenforceable in whole or in part, such circumstance shall affect only that provision, or part thereof, and the remainder of these Standard Terms and Conditions shall continue to apply unless the provision found to be invalid or unenforceable is essential to these Standard Terms and Conditions, in which case these Terms and Conditions shall be null and void in full.

V. Applicable Law and Jurisdiction

These Standard Terms and Conditions and any applicable Special Terms and Conditions shall be subject to and interpreted in accordance with the laws of Spain.

For any dispute that may arise, the parties submit to the jurisdiction of the courts as determined in accordance with applicable rules of legal procedure and with consumer and user protection regulations.
